At Sports Athletic, we protect your personal data. Here we want to inform you about the scope and purpose of the data collection.

 

Principle of the anonymous use of data

You can find the legal basis of data protection in particular in the General Data Protection Regulation (GDPR).

When you visit our website or app, some information is transmitted, such as the IP address. They also provide information about the device used (computer, smartphone, tablet, etc.), the browser used (Internet Explorer, Safari, Firefox, etc.), the time of access to the website, the so-called referrer and the amount of data transferred.

We cannot use this data to identify the individual user. The information is used to determine the attractiveness of our offers and, if necessary, to improve their performance or content and make them even more interesting for you.

However, we would like to point out that with a static IP address via a RIPE query, a personal reference may be possible in individual cases, but we do not do this. Nevertheless, this website is accessible to statically as well as dynamically assigned IP addresses.

Collection and processing of personal data

Sports Athletic processes personal data about you. This happens, for example, if you inform us of this yourself, when you contact us, in particular when registering a Sports Athletic account or when you publish information within our Sports Athletic app in your profile or in the feed.

We only use the personal data you provide to the extent that your data is necessary for the fulfillment and processing of our services.

We store your data for as long as it is necessary to fulfill the intended purpose, or until you delete your account or statutory retention periods make it necessary to store it. Your data will then be deleted or processing restricted in accordance with the statutory provisions.

In the case of purely informational use, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you want to view our website, we collect the data that is technically necessary for us to display our content to you and to guarantee stability and security (the legal basis is the legitimate interest in accordance with Art. 6 Para. 1 S. 1 f) GDPR ).

As part of the balancing of interests in accordance with Art. 6 Paragraph 1 f) GDPR, we have taken into account and weighed our interest in the provision and your interest in processing your personal data in accordance with data protection regulations. Registration with Sports Athletic


You can create a Sports Athletic account using our login system. We use cookies - small files - in your browser to identify you. All data that you store in your account are stored in a Google Firebase database of Google Ireland Limited (see point "Google Firebase"), which is managed by Horizon Alpha GmbH & Co. KG (Horizon Alpha). We commissioned Horizon Alpha to create the Sports Athletic app. For this purpose, we have concluded a data processing contract with so-called standard contractual clauses, in which Horizon Alpha undertakes to process user data only in accordance with our instructions and to comply with the EU data protection level. Registration with Facebook or Google

We also offer you the option of logging into Sports Athletic using your Facebook or Google account (so-called "single sign-on registration" or "authentication"). Use the Facebook or Google switch instead of other options when registering your Sports Athletic account. You will then be forwarded to Facebook or Google (where you have to be logged in or need an account) and you will then be told which data we need from you from Facebook or Google. The authentication takes place directly on Facebook or Google. As part of this authentication, we receive a user ID with the information that you are logged into Facebook or Google under this user ID and an ID that we cannot use for other purposes (so-called "user handle") Additional data is transmitted depends solely on the single sign-on procedure used, the selected data releases as part of the authentication and also on which data you have released in the privacy or other settings of your Facebook or Google user account . Community profile

Your data is displayed in the team evaluation so that you, your team members and your coach can observe your training progress among each other. So that you can decide for yourself whether and which data you want to publish, we present our program in more detail below. This includes, in particular, the following information, which is visible to other users:

  • Training information (duration of your training and the focus of your training, number of training, points collected, weight moved, current title or title you have selected)
     

In our general terms and conditions, you already agree that as soon as you join a team and as long as you do not make any changes to the settings, all Sports Athletic users can view your profile, your training data, your posts, etc., even without special permission. This should make it easier for team members and coaches to motivate and support each other and across teams. If you no longer want this, you can switch off the approval of your evaluations in the settings at any time.

If you do not want to be associated with your achievements, you should choose a fantasy name as your username and not upload a profile photo. In order to prevent other users from viewing your data, you should not join a team.

You also have the option to report complaints and sore muscles. We process these entries so that you receive your individual training plans every day. The complaints are only saved as long as you leave them marked, and the sore muscles only for the respective day.

Access permissions

We need these access options and information about the technical functionality of our app and to provide the services offered with the app, in particular to access your camera or photos to insert a profile photo, to send you push messages that you have new comments  from your team or important training information. During the installation process or before using it for the first time, we ask for permission to access the individual functions and information and will only access these functions if you consent to a release. Depending on the operating system, you can revoke the access rights manually in the settings. You can find out how this works in the manufacturer's instructions for your mobile OS. Please note, however, that you can only use the app to a limited extent or not use it without the relevant approval.

Newsletter

You can register for our newsletter if you want to keep us informed about news or to receive information on selected topics and products that are mentioned in the declaration of consent.

We need your valid email address to register.

The provision of further, separately marked data is voluntary and is used in order to be able to address you personally. This is only done with your separate consent.

To make sure that you actually want to receive information from us, we use the so-called double opt-in procedure. After you have registered, you will receive a link by email that you can use to activate the newsletter service. This means that after you have registered, we will send you an email to the email address provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will not be saved in our e-mail dispatch tool. In addition, we save the IP addresses you used and the times of newsletter registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

User surveys

Google Marketing Services

This homepage also uses the marketing and re-marketing services of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), which enable us to display advertisements in a more targeted manner in order to present you with interesting advertisements. All user data are only processed as pseudonymous data. Google doesn't store names or email addresses. All displayed advertisements are therefore not displayed specifically for a person, but for us of the cookie. This information is recorded by Google and transmitted to servers in the USA and stored there.

One of the Google marketing services we use is the online advertising program Google AdWords. In the case of Google AdWords, each AdWords customer receives a different conversion cookie. Cookies cannot therefore be tracked via the apps of AdWords customers. The information collected with the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that personally identifies users.

We can include third-party advertisements based on the Google marketing service DoubleClick. DoubleClick uses cookies to enable Google and its partner apps to display ads based on user visits to this app or other apps on the Internet.

Firebase

We use the Firebase service from Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) to analyze your user behavior. We use the collected data to view your interaction with our app. Firebase is part of the Google Cloud Platform and offers various services for app developers. Some Firebase services process personal data. In most cases, the personal data used is limited to so-called instance IDs, which are provided with a time stamp. The instance IDs created by Firebase are only used once and therefore enable assignment to specific events or processes. The data collected is not personal data and we do not take any measures to personalize it afterwards. We use the data collected to analyze user behavior and optimize the user experience, for example by evaluating crash reports.

We currently use the following Firebase services:

Google Analytics for Firebase: Google Analytics uses the collected data to provide analyzes and attribution information. Google Analytics stores ID-related data for 60 days and collected reporting and campaign data for an unlimited period, unless we change the settings for data storage on Google Analytics or delete the project.

For Analytics for Firebase, Google not only uses the instance ID mentioned above, but also the advertising ID of the end device. You can change the use of the advertising ID in the device settings of your mobile device.

Firebase Remote Config: Remote Config uses instance IDs to select configuration values and transfer them to end-user devices. Firebase stores instance IDs until the Firebase customer uses an API call to delete the ID. The data is deleted from both live servers and all backups within 180 days of being accessed.

Firebase Dynamic Links: Dynamic Links uses data from iOS devices to open newly installed apps on a specific page or in a specific context. Dynamic Links only temporarily stores device data in order to provide the service.

Firebase Cloud Messaging: Firebase Cloud Messaging is used to send push notifications or so-called in-app messages (notifications that are only displayed in the respective app). For this purpose, the mobile device is assigned a pseudonymized push reference that serves as the “destination” for the push notification or in-app message. You can deactivate and reactivate push notifications at any time using the settings on your mobile device.

Firebase Cloud Messaging uses instance IDs to determine which devices messages should be delivered to. Firebase stores instance IDs until we initiate the deletion of the ID with the help of an API call. The data is deleted from both live servers and all backup systems within 180 days of being accessed.

Firebase uses this data on our behalf for the above-mentioned purposes.

The legal basis for the use of Google Analytics is your consent in accordance with Art. 6 Para. 1 lit. a GDPR. You can revoke your consent at any time with effect for the future: To do this, go to the "Profile" menu item in the Sports Athletic app, open the "Data protection" section and then deactivate the "Google Firebase" item.

Google is part of the EU-US Privacy Shield Agreement ( https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active ) and thus guarantees compliance with European data protection laws.

Facebook Marketing Services

We use pixels from Facebook Inc. (Menlo Park, California) on our website so that your user behavior can be tracked after you have been redirected to our website by clicking on a Facebook ad. Facebook pixels enable us to only show the Facebook ads we have placed to users who are likely to be interested in our offer. Social media fan pages

Sports Athletic maintains so-called fan pages on social media providers such as Instagram and Facebook (both: Facebook Inc. Menlo Park, California) in order to communicate with customers, interested parties and users active there and to inform them about our products, services and events. User data outside the EU can be processed. The aforementioned US providers are part of the EU-US Privacy Shield Agreement and thus guarantee compliance with European data protection laws.

According to the European Court of Justice (ECJ), we are jointly responsible with Facebook for the processing of your personal data. When you use the fan pages, the following data is collected from you for the purpose of user communication and target group advertising:

  • Statistical data on user interactions in aggregated form, i.e. without personal reference (e.g. page activities, page views, page previews, likes, recommendations, articles, videos, page subscriptions including origin, times of day)
     

The promotional use of personal data is particularly important for Facebook. We use the statistics function to find out more about the visitors to our fan pages. The use of this function enables us to adapt our content to the respective target group. In this way, we also use the demographic information on the age and origin of the users, although it is not possible for us to reference them personally.

In order to provide the social media service in the form of our fan pages and to use the Insights function, Facebook usually stores cookies on the user's device. These include session cookies, which are deleted when the browser is closed, and persistent cookies, which remain on the end device until they expire or are deleted by the user.

We use the Insights function for statistical analysis purposes. In this context, we receive anonymized data on the users of our fan pages. The processing of the personal data of the users takes place on the basis of our legitimate interest in an effective information of the users and communication with the users as well as for the purpose of statistical evaluation according to Art. 6 I lit. f GDPR.

 

Transfer of data to third parties

We only pass on your personal data to third parties if:

  • You have given your express consent

  • the disclosure is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,

  • in the event that there is a legal obligation for the disclosure, as well as

  • this is legally permissible and necessary for the execution of contractual relationships with you
     

When data is transferred outside of the European Union, the high level of European data protection does not generally apply. In the case of a transfer, it may be that there is currently no adequacy decision by the EU Commission within the meaning of Art. 45 Para. 1, 3 GDPR. This means that the EU Commission has not yet positively determined that the country-specific level of data protection corresponds to the data protection level of the European Union based on the GDPR, which is why we have created the aforementioned suitable guarantees.

Possible risks that may not be completely ruled out in connection with the data transfer are in particular:

  • Your personal data could possibly be processed beyond the actual purpose.
